for john brennan, president obama's nominee to heat cia, it was held in the intelligence committee in the senate, right? well, specifically it's called the u.s. senate select committee on intelligence. this committee was not created until 1976. it was created specifically in response to the recommendations of the church committee. the church committee was a special senate investigation led by idaho senator frank church. it was formed in 1975. their work took nine months and 150 staffers. they produced a two-foot-thick report in may 1976 that said, among other things, that we need congress to oversee intelligence in this country. the way we are overseeing it now is not working. and you know why we can tell that oversight is not working? because the cia keeps killing people. or trying to kill people in other countries that we are not at war with. the cia at the time had taken it upon itself, it wasn't clear if they were acting alone or at various presidents' direction, but they had taken on the job of assassinations in foreign countries. assassinations and attempted assassinations. a

, no response required. mr. brennan, that is your shop. do you have any knowledge about why senator graham's question was not to be answered? >> there is a longstanding tradition understanding of respecting the executive privilege that exists in the presidency in terms of what information is provided to the president or advice, counsel, to him. i would suspect that that question gets into this issue of the executive privilege which i think again has been a long standing tradition. >> are you sure that is the answer or to you think? >> i do not understand, because that will not be a request coming to me. >> i understand, so my direction to you, at what i ask you, is that you review that. we will get you the and -- we will get youppi if necessary., efficient ca alice told us it was detainee information that was key to them finding the courier and bin laden. were you briefed by any of the analysts who track down bin laden? >> before the operation? but yes. >> yes, absolutely. >> is that the information given to you, that it came from interrogation of detainees on whom eip's had been used? >>

brennan, the headline of "the national journal" says john brennan shows hagel how it's done. we had another drone attack today. seven people killed in pakistan. an area outside of pakistan. none are civilians according to u.s. officials. nevertheless, the dynamic there, the clearing of the chamber and some of the tough questions from democrats to brennan, how do you measure his performance yesterday and the answers he gave? >> you know, i think a frustration was built around mostly the cia and the really hostile relationship between congress and the agency over the years and what lawmakers feel is the agency's failure to brief them adequately on a lot of secret operation that is are happening overseas. i think brennan is generally safe. he did perform satisfactory according to a lot of these -- the key democrats an some of the republicans on the panel and will get confirmed. i think that will happen in the next couple of weeks but look for the issue of the drone strikes and whether or not there needs to be more oversight to become a hot issue in the next weeks. >> senator bob menend

, senator what are you up to? he said i'm on a crusade. he said i'm on a tear. i'm out after john brennan. of course, the president's nominee to head the c.i.a. i said on what issue? he said on drones, of course. on drones. this is -- this guy is the architect of our whole drone policy. i told him. this is something that i've talked about on the show. i'm very concerned about the use of these drones. i'm torn about it but very concerned about it. and i said to him you know, i think this is an issue that's going to blow up in our face. he said you bet. we haven't seen a copy of it yet. he told me he was releasing a letter yesterday signed by -- i think he said 16 senators, republicans and democrats to the president saying we need the information on exactly what we're doing with these drones. what the policies are. what the guidelines are and who decides. now, this story has broken. all these questions about drones and now the justice department has just released a memo. it is a confidential memo, a copy of it has been obtained, story again just breaking this morning, a story -- the memo, c
hearing for john brennan, the president's nominee, a good man, to be the next director of the cia. and brennan is known at the whitehouse, among other things, former deputy at cia, for being the architect of america's drone policy. he is the one who decides when drones are used and who they are targeted and what american citizens might be targeted. this is bound to come up. several senators have already told me they are going to craze this question with john brennan and publicly said so. and just at the time they are preparing for this hearing this white paper, this was written by department of justice, for members of congress and sent to them last summer but for some reason, it never -- nobody ever leaked it until this week. we still don't know who leaked it. but this paper is pretty chilling. the paper is an unclassified document. so there is no breach of national security here and it's a department of justice explaining why they think the use of drones to kill american citizens on foreign soil is just justified justified. and they say it is -- it'
